Terminations, redundancies and restructures
Advice on genuine redundancy, consultation obligations, process, and documentation, before a decision is communicated (not after).
Workplace policies

Employment contracts, policies and workforce documents managed in Xemplo

Automate what you can. Tailor what you need.

Having the right contracts and policies is only part of the equation. Risk often arises when documents are modified inconsistently, outdated versions remain in circulation, or different managers adopt different processes.

Xemplo enables organisations to configure approved employment contracts (using Xemplo’s proprietary contract builder), policies, letters, and workforce documents within the platform – helping teams leverage consistent content and processes across future hires and workforce activities.

Some situations require more than standardised content and workflows. Where legal judgment, interpretation, or organisation-specific drafting is required, Xemplo Legal can provide employment law advice and assistance to support those matters.

This allows businesses to combine standardised and automated workforce processes through Xemplo with access to legal support when a matter requires a tailored response.

Work directly with experienced employment law and workforce specialists who understand both the legal obligation and how it plays out operationally.
ALSO SPONSORING WORKERS?

Employment and migration obligations can overlap

A payroll error can become an underpayment claim and a sponsorship breach at the same time. A role change can affect nomination conditions. A restructure can put a visa at risk.

Xemplo Legal advises on both fronts. If you employ people on visas, our corporate migration team works alongside the employment practice. That way, two sides of the obligation are handled by one firm.

FAQs

Questions about employment law for employers

Looking for guidance on contracts, workplace issues, employee performance, or termination?
Here are answers to some common questions from Australian employers.
When should I call an employment lawyer?

Before you act, not after. The most useful time to get advice is while a decision is still reversible – ahead of communicating a termination, starting a performance process, restructuring a team, or changing someone's role/pay. Once a decision has been implemented, your options narrow and the cost of fixing it rises.

How much does employment law advice cost?

For one-off matters, we agree upon a fixed fee after scoping the work (so you know the cost before it starts). Ongoing support is available as an annual arrangement for businesses that want continuing access to a lawyer. We'll confirm fees in writing before any work actually begins.

Who will actually be advising me?

Xemplo Legal is led by Principal Lawyer Sean Loughland, who oversees every employment matter the practice takes on. You'll be dealing with a lawyer, not a call centre.

Can you help us avoid an unfair dismissal claim?

We can advise on the process, evidence, and documentation that offers a termination the best chance of withstanding challenge – and on whether the dismissal may be defensible before it happens. No lawyer can guarantee that an employee won't lodge a claim, but most successful claims turn on avoidable process failures.

We're a small business. Is this relevant to us?

Yes, and often more so. Smaller employers carry the same obligations without an in-house HR or legal team, which is where most avoidable exposure comes from. Small business also has specific rules (including the Small Business Fair Dismissal Code) which could change how some terminations are handled.

We're based overseas but employ people in Australia. Can you help?

Yes, certain Australian employment law obligations may attach to the work performed here and overseas employers are frequently caught out by award coverage, minimum entitlements, and termination process. We advise on the Australian side of the arrangement and work alongside your local advisers elsewhere.

Do we have to use the Xemplo platform?

Not to get advice on a one-off matter. The ongoing service is built around it, though approved contracts are issued to every new hire, policies are updated when the law changes, and acknowledgements are captured without anyone chasing them. We offer additional legal support on the best application of these products delivered via the Xemplo Platform. None of that works unless your workforce processes run through Xemplo. If you're looking at continued support, we'll cover the platform as part of scoping the engagement (before you commit to anything).
